1. Scope of Application
These General Terms and Conditions apply to all orders placed through our online shop.
2. Contracting Parties, Conclusion of Contract
The purchase contract is concluded with ALL FOR YOU GmbH.
By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose in the ordering process. The contract is concluded by clicking on the order button to accept the offer for the goods contained in the shopping cart. Immediately after sending the order, you will receive a confirmation by email.
3. Contract Language, Storage of Contract Text
The languages available for concluding the contract are German and English.
We store the contract text and send you the order data and our terms and conditions by email. You can view the contract text in our customer login.
4. Delivery Conditions
In addition to the stated product prices, shipping costs will be added. Further information on the amount of shipping costs can be found with the offers.
We only deliver by shipping. Unfortunately, self-collection of the goods is not possible.
5. Payment
The following payment methods are generally available in our shop:
Advance payment
If you choose the payment method advance payment, we will provide you with our bank details in a separate email and deliver the goods after receipt of payment.
Cash on delivery
You pay the purchase price directly to the deliverer. There are no additional costs for this.
Credit card
By placing the order, you simultaneously provide us with your credit card details. After your legitimate identification as the rightful cardholder, we will immediately request your credit card company to initiate the payment transaction. The payment transaction is automatically carried out by the credit card company and your card is charged.
PayPal
During the ordering process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, authenticate yourself with your access data, and confirm the payment instructions to us. After placing the order in the shop, we request PayPal to initiate the payment transaction.
The payment transaction is carried out by PayPal immediately afterward. Further information will be provided during the ordering process.
Immediate bank transfer
After placing the order, you will be redirected to the website of the online provider Sofort GmbH. To pay the invoice amount via Sofort, you must have an online banking account with a PIN/TAN procedure that has been activated for participation in Sofort, authenticate yourself accordingly, and confirm the payment instructions to us. Further information will be provided during the ordering process. The payment transaction is then carried out immediately by Sofort and your account is debited.
Amazon Pay
During the ordering process, you will be redirected to the website of the online provider Amazon before completing the order process in our online shop. To process the order and pay the invoice amount via Amazon, you must be registered there or register first and authenticate yourself with your access data. There you can choose the delivery address and payment method stored at Amazon, confirm the use of your data by Amazon, and the payment instructions to us. You will then be redirected to our online shop, where you can complete the order process.
We request Amazon to initiate the payment transaction immediately after dispatching the goods. The payment transaction is automatically carried out by Amazon. Further information will be provided during the ordering process.
6. Promotional Vouchers
a. Promotional vouchers are vouchers that cannot be purchased but are issued by us within the framework of advertising campaigns with a certain validity period.
b. Promotional vouchers can only be redeemed once within the specified period and only once per order process. Individual brands may be excluded from the voucher promotion. Promotional vouchers cannot be used to purchase gift vouchers. Please note that promotional vouchers may be subject to a minimum order value.
c. The value of the goods must at least correspond to the amount of the promotional voucher. Any difference to a higher value of goods can be offset with the offered payment methods. The value of a promotional voucher is neither paid out in cash nor interest-bearing. The promotional voucher will not be refunded if goods are returned in whole or in part.
d. Promotional vouchers can only be redeemed before completing the ordering process. Subsequent crediting is not possible. The promotional voucher cannot be transferred to third parties. Multiple promotional vouchers cannot be combined unless otherwise agreed upon by us.
e. If you have used a promotional voucher for your purchase, we reserve the right to charge you the original price of the goods you keep if – due to your revocation – the total value of the order falls below the respective value of the promotional voucher or corresponds to it.
7. Gift Vouchers
a. Gift vouchers are vouchers that you can purchase. These can only be redeemed for the purchase of dirndls and traditional costumes for women, men, and children, but not for the purchase of additional gift vouchers. If the credit of a gift voucher is not sufficient for the order, the difference can be offset with the payment methods offered.
b. Gift vouchers and credits can only be redeemed before completing the order process. The credit of a gift voucher is neither paid out in cash nor interest-bearing.
8. Sales Promotion 'Buy 3 - Pay 2
If you add 3 items to your shopping cart, you will receive the cheapest item for free. Please note that when returning one or more items from this promotion, the 'free' item must be paid for. The value of the 'free item' will be offset against the credit of the returned items.
9. Retention of Title
The goods remain our property until full payment has been made.
10. Transport Damages
If goods are delivered with obvious transport damages, please complain about such defects as soon as possible to the deliverer and please contact us immediately. The failure to lodge a complaint or to contact us will not have any consequences for your statutory claims and their enforcement, especially your warranty rights. However, it will help us to assert our claims against the carrier or the transport insurance company.
11. Warranty and Guarantees
The statutory warranty rights apply. Information on any additional guarantees and their precise conditions can be found with the product and on special information pages in the online shop.
12. Liability
We are always liable without limitation
for damages resulting from injury to life, body, or health,
for intentional or grossly negligent breach of duty,
for guaranteed promises, if agreed, or
to the extent that the scope of the Product Liability Act is opened.
In the event of a breach of material contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations), by slight negligence on our part, our legal representatives, or vicarious agents, liability is limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.
13. Dispute Resolution
The European Commission provides a platform for online dispute resolution (OS), which you can find here:
https://ec.europa.eu/consumers/odr/. Consumers have the opportunity to use this platform to resolve their disputes.
We are obliged to participate in dispute resolution proceedings before a consumer arbitration board to settle disputes arising from a contractual relationship with a consumer or to determine whether such
a contractual relationship exists. The responsible authority is the Verbraucherschutzstelle gemeinnütziger e.V. Niedersachsen, Breite Straße 10, 37077 Göttingen, Germany, http://www.verbraucherschutzstelle.de/konfliktfall.htm. We will participate in dispute resolution proceedings before this authority.
Right of Withdrawal
Right of Withdrawal
You have the right to revoke this contract within thirty days without giving any reason.
The withdrawal period is thirty days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.
To exercise your right of withdrawal, you must inform us (ALL FOR YOU GmbH, Boschweg. 13, 12057 Berlin, info@bohmberg.de, Germany) of your decision to withdraw from this contract through a clear statement (e.g., a letter sent by post, fax or email). You can use the attached sample withdrawal form for this purpose, which is not mandatory, however.
You can also electronically fill out and submit the sample withdrawal form or another clear statement on our website https://www.bohmberg.de/widerrufsformular. If you make use of this option, we will immediately (e.g., by email) send you a confirmation of receipt of such a withdrawal.
To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of Withdrawal
If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (except for additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), immediately and no later than fourteen days from the day on which we received notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day deadline. We bear the costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that are not necessary for checking the condition, properties, and functioning of the goods.
